Another Disgusting Update on IRD---the Nonprofit USAID Contractor

by Gary Snyder

The largest nonprofit contractor working for the U.S. Agency for International Development during the height of the wars in Iraq and Afghanistan billed the government $1.1 million for staff parties and pricey retreats.

International Relief and Development of Arlington, Va., collected hundreds of millions of dollars to work in the war zones and help impoverished nations around the world. At the same time — between 2007 and 2010 — its executives were using IRD’s government overhead account to fund the parties and retreats, according to financial records provided by IRD to The Washington Post.

Three parties and retreats were held at one of the poshest destinations on the East Coast, Nemacolin Woodlands Resort in Pennsylvania, in the Allegheny Mountains near Fallingwater, the famous home designed over a waterfall by Frank Lloyd Wright. IRD spent $484,338 on those retreats at the height of U.S. war spending, billing the expenses to the government as “training” and “staff morale” items, according to the records and current and former employees.

Among the perks they received at Nemacolin: private rooms; open bars; gala dinner parties; free iPods at one retreat, Nikon Coolpix cameras at another; skeet-shooting outings at the resort’s Field Club; extreme-driving classes at its Jeep Off-Road Driving Academy; and complimentary $50 gift certificates to spend on clothing, jewelry, massages — whatever the employees wanted.

In addition to the retreats at Nemacolin, IRD spent $58,828 on “leadership” meetings at the Hyatt Regency Chesapeake Bay Golf Resort, Spa and Marina in Cambridge, Md. The nonprofit also billed the government $63,746 for an awards reception in October 2010 at the Newseum in Washington and $72,530 for a holiday party that December at the Smithsonian National Air and Space Museum on the Mall.

In January, USAID suspended IRD from receiving any more federal work, citing other spending that involved “serious misconduct.” The suspension came in the wake of allegations of misspending highlighted in a Post investigation in May 2014.

A new chief executive, Roger Ervin, took over at IRD in December and has forced seven of the nonprofit group’s longtime officers to resign and removed its board members. The nonprofit’s annual revenue from USAID has plummeted from $587 million in 2010 to $78 million last year.

Jean M. Hacken had been hired that year as the nonprofit’s chief compliance officer. “They were spending so much money,” said Hacken, who left IRD in December. “I really didn’t understand. It seemed very lavish to me. I didn’t think a nonprofit organization should be doing that.”

For-profits Taking Up To 50% or more of Charities' Collections

by Gary Snyder

The for-profit firms that raise money for charities collected $361.3 million from well-meaning Californians in 2013 – and pocketed $161.2 million, or 45.5 percent, of the take, according to the latest figures from the Attorney General’s Office.

That’s better than the year before, when commercial fundraisers kept 63 percent of the money raised in nonprofits’ names.

Thirty-one Orange County charities used commercial fundraisers in 2013, according to the attorney general’s data, and they fared a bit worse than their cohorts statewide. Of the $3.9 million raised on behalf of Orange County charities, commercial fundraisers kept $1.9 million, or about half the take.

The most extreme cases raise far less than the average. According to the data:

• One commercial fundraiser logged $332,000 for Plan International USA, a highly rated charity that operates in 50 developing countries trying to end the cycle of poverty for children. That campaign wound up costingthe charity all that – plus an additional $3.5 million.

• Another for-profit fundraiser drummed up $687,000 for the well-regarded Save the Children Federation. That cost $1.8 million.

• A campaign for Open Doors With Brother Andrew of Santa Ana raised $7,753 – of which the charity got $7.75. Open Doors serves persecuted Christians in more than 60 countries.

• A campaign for Amvets in Anaheim raised $10,158, but wound up costing it $34,367. Amvets runs thrift stores that support, promote and defend the rights of California veterans and their families. (source)

Charity Fraud: $11 Million Taken From North Carolina Companies

by Gary Snyder

James Staz and his father, William Staz operated payroll company Employee-Services.net which collected and paid employment taxes. Except they didn’t pay.

They pleaded guilty to stealing  $11 million from clients and used it to fund a lavish lifestyle, including strip club visits and three-tiered pools. James Staz on a single day "spent a total of $38,880 at strip clubs and night clubs," the indictment indicated.

The executive director of one of the victim companies, The Chapel Hill Training-Outreach Project, said the first realized something was wrong in early 2014. "We received a phone call from an IRS agent asking us where our most recent tax withholdings check was," said Mike Mathers, executive director for the company. The nonprofit helps children with disabilities.

The father and son's company once had around "500 client companies located in North Carolina" and other states, according to the indictment. (source)

Charity Fraud: Detecting, Preventing, and Investigating Fraud, Embezzlement, and Charitable Diversion

By Gary Snyder

In light of the disturbing numbers reported by the Washington Post, Congress and numerous state attorneys general have pledged to launch investigations, and reportedly, some have. This will likely lead to even greater scrutiny by government regulators.

External audits are necessary to ensure that effective financial controls and fraud prevention measures are being followed, but a standard audit is not the method by which nonprofit organizations should expect to detect fraud. The Association of Certified Fraud Examiners (ACFE) reports that less than 4% of frauds are discovered through an audit of external financial statements by an independent accounting firm.

Nonprofits may no longer elect to handle instances of fraud or embezzlement quietly to avoid unwanted attention and embarrassment. As of 2008, a larger nonprofit must publicly disclose any embezzlement or theft exceeding $250,000, 5% of the organization's gross receipts, or 5% of its total assets. A tax-exempt organization whose gross receipts are greater than or equal to $200,000—or whose assets are greater than or equal to $500,000—is subject to additional public disclosure requirements on its IRS Form 990 concerning the embezzlement or theft.
