NFL Moves To Revoke Its Nonprofit Status

The National Football League’s central office will become a taxable entity, ending its tax-exempt status in a move with minimal financial effect and significant symbolic value. 

The league’s decision pre-empts a move to revoke the tax break that had been led by former Senator Tom Coburn of Oklahoma. For the NFL, the costs of losing the tax break are minimal, an estimated $109 million over the next decade. 

There are benefits for the league, too, including the end of federal disclosure requirements that put Commissioner Roger Goodell’s salary and some other league information in the public domain. 

The NFL’s move mirrors one made by Major League Baseball in 2007. The National Basketball Association never was tax exempt. The National Hockey League is now the only major professional sports league in North America with the status.

Charity President Embezzles Nearly $5 Million

United Mid-Coast Charities and its former longtime president have reached an agreement in which he will pay the group more than $4.6 million in connection with his alleged embezzlement of funds from the organization.

United Mid-Coast Charities President Stephen Crane announced in a news release that Russell “Rusty” Brace admitted to breach of duty, fraud and conversion of money belonging to the charity after his theft of hundreds of donation checks made payable to the charity.

The settlement is for $4,646,636, according to the news release.

In order to partially satisfy judgment, Brace has agreed to sell properties that he owns and turn over his interests in the sale proceeds to the charity. He also has agreed to turn over all the money that he holds in bank accounts as well as his interest in certain items of personal property that will be sold.

Jay McCloskey, attorney for the charity, said that “in order to settle this case, the charity required Mr. Brace to agree to liquidate virtually all his assets and turn over the proceeds to UMCC. At the end of the day, I think the charity will recover a substantial portion of the money that was stolen from it.”


No criminal charges have yet been filed against Brace although Brace’s attorney Peter DeTroy has said they will be filed.

Increase In Charity Fraud

Nonprofit fraud is on the rise, according to a number of sources, and may account for 10% of all fraud in the U.S. The implication is that many nonprofits are at risk, probably due to a deficit in financial controls.
"Financial control failures are common at nonprofits and can sometimes be fatal. Leaders of nonprofits would be well served to take steps to assess their risk, tighten controls and detect fraud as early as possible
Nonprofit fraud is happening more often and costing more money. According to the 2014 Report to the Nations by the Association of Certified Fraud Examiners, nonprofit fraud accounted for 10.8% of total frauds in 2013, up from 9.6% reported in 2010. Nonprofit organizations lost a median $108,000 per fraud in 2013, up from $90,000 reported in 2010. (source)

Nonprofit Boards Put On Notice

In what should be a ringing alarm for nonprofit boards across the country long accustomed to minimal scrutiny or accountability, Attorney General Eric T. Schneiderman of New York has signaled that the laissez-faire approach to nonprofit governance is over.

Mr. Schneiderman’s office has sent letters to the board members of Cooper Union for the Advancement of Science and Art, the prestigious college founded in Manhattan in 1859 by the philanthropist Peter Cooper on the premise that it be “open and free to all.” Last year, after the school said it faced financial ruin otherwise, it began charging tuition.

The investigation, reported earlier by The Wall Street Journal, is focusing on the board’s management of its endowment; its handling of its major asset, the Chrysler Building; its dealings with Tishman Speyer Properties, which manages the skyscraper; and how it obtained a $175 million loan from MetLife using the building as collateral, according to people involved.
